Government Tender Compliance Requirements: What Gets You Disqualified

The most brilliant proposal in the world is worthless if it fails compliance. Here are the most common reasons tenders are rejected — and every one of them is avoidable.

Administrative Failures (Instant Disqualification)

• Late submission — even by one minute. Portals lock at the deadline. No exceptions.
• Wrong format — submitting a PDF when they asked for Word, or exceeding the file size limit
• Missing signatures — anti-collusion declarations, Modern Slavery statements, or director sign-off
• Incomplete forms — leaving mandatory fields blank or writing "N/A" where a substantive answer was required
• Wrong portal — emailing a bid when the instructions said "submit via the e-procurement portal only"

Financial & Legal Failures

• Insufficient turnover — most contracts require annual turnover of at least 2x the annual contract value
• Inadequate insurance — professional indemnity, public liability, and employer's liability all need to meet minimum thresholds
• Exclusion grounds — failing to declare previous convictions, tax non-compliance, or conflicts of interest
• Expired certifications — attaching an ISO certificate that lapsed 3 months ago

Technical & Quality Failures

• Not answering the question asked — writing about your company when they asked about your methodology
• Exceeding word counts — evaluators may stop reading or score zero beyond the stated limit
• Generic, non-specific responses — "We have extensive experience" without naming projects, dates, or outcomes
• Missing the Social Value section — with a minimum 10% weighting, this alone can eliminate you
• Ignoring evaluation criteria weightings — spending 3 pages on a 5% criterion and 1 page on a 40% criterion

How to Avoid These Failures

Create a compliance checklist for every bid. Before writing starts, extract every mandatory requirement and pass/fail criterion from the tender document. Check off each item as you complete it. Have a second pair of eyes do a final compliance review 24 hours before submission.
